I'm happy to report another jury trial victory. This time it was in the Wayne District Court. In this case, my client was charged with domestic assault. He was dropping off his child at his former girlfriend's house when an argument ensued. That is where the stories changed. The ex-girlfriend indicated she was pushed to the ground and her face struck the side mirror of my client's vehicle. My client said it never happened. He indicated that she made it all up to gain the upper hand in a custody case.
Through cross examination, we were able to completely discredit the ex-girlfriend. She lied in multiple instances and her credibility was hurt very badly. The Wayne County Prosecutor who was handling the case had her "Perry Mason Moment" when she produced a text message from my client that basically apologized for making things "physical." However, the damage was already done. The credibility of the ex-girlfriend was so much in question that the jury returned their not-guilty verdict in about 15 minutes.
