Injuries can happen to anyone. The law may provide a remedy if another person was the cause of your injury. Generally, there are two steps in determining whether a claim or lawsuit is in your best interests. First, the other party has to be legally responsible. This can be an intentional act (i.e. assault and battery) or a negligent act (i.e. accident). Second, even if a person is legally responsible, the severity of the injury and the likely recovery must be taken into account. Just because someone is negligent, for example, does not necessarily mean that the eventual recovery will justify a long and costly lawsuit.
