Wow!

This was an interesting one for me.  My client had a few drinks in the comfort of his own home when his neighbor asked that he follow him down to the edge fo the driveway to "look at the property lines."

The spot that the neighbor wanted my client to look at was about 1/4 mile away so my client drove his vehicle there.  The minute my client stepped outof his vehicle he as vicously attacked.  My client was beaten to near death and crawled back to his vehicle and drove away.  Near death, he ran into the back of a vehicle near his house.  He was rushed to the hospital where he spent 2 days in the ICU.

He was later charged with a DUI.  We successfully argued that he was under duress when he drove away from his attacker.  The jury was out for about 10 minutes before they returned a not-guilty verdict.  Interestingly enough, one of the people that my client ran into on the road apologized to him because she did not know the whole story.
